This Agreement sets out the terms between CubexContainers, LLC ("CubexContainers") and the Customer listed on the applicable order form. By renting or purchasing a unit, Customer agrees to these legally binding terms.
1Rental Agreement
CubexContainers rents the unit(s) listed on the order form to Customer under these terms.
2Payments
Rent is billed every 4 weeks starting on the delivery date.
Delivery and pickup fees are charged on the first invoice unless otherwise agreed.
Invoices are due within 10 days.
Late payments may result in fees, interest, or collection costs.
Customer authorizes automatic ACH or credit card payments and is responsible for failed payment fees.
3Ownership
All rental units remain the property of CubexContainers.
Purchased units transfer ownership only after full payment.
4Delivery & Site Requirements
Only CubexContainers may move rental units.
Customer must provide clear access, a level surface, and required permits.
Units must be empty, unlocked, and broom-clean at pickup.
Additional charges may apply for access delays or site issues.
5Condition & Damage
Units are provided as-is and accepted in good condition unless noted at delivery.
Customer is responsible for damage beyond normal wear and tear.
CubexContainers is not responsible for surface or property damage related to placement.
6Insurance
Customer must maintain at least $1,000,000 in general liability coverage.
CubexContainers, LLC must be listed as additional insured and loss payee.
Customer assumes risk for fire, theft, weather, or other loss.
7Liability & Indemnification
Each party is responsible for its own negligence or breach.
CubexContainers is not liable for loss or damage to Customer property.
8Default
Customer defaults if payments are not made or terms are breached and not corrected within 10 days.
CubexContainers may terminate the Agreement and recover the unit.
Customer remains responsible for unpaid amounts and related costs.
9No Warranty
Units are provided without express or implied warranties, including fitness for a particular purpose.
10Legal Compliance
Customer must comply with all laws and regulations.
Hazardous or illegal materials are prohibited.
11Force Majeure
CubexContainers is not responsible for delays beyond its reasonable control.
12Governing Law & Disputes
This Agreement is governed by Indiana law.
Disputes may be resolved through binding arbitration in Indiana under AAA rules.
Changes must be in writing and signed by both parties.
